6. Subcontractors
If self-employed individuals and/or other companies carry out work in the name of your employer, the Competent Person must make sure “due diligence” is carried out.
In practice this means checking subcontractors to make sure they are competent, have appropriate insurance in place and up to date and that they comply with health and safety legislation.
The Company can be held to be liable for any accidents or incidents caused by subcontractors. Self-employed individuals are not required to have a written health and safety policy, so it makes sense to require them to abide by the Company’s own Policy.
